Terms of Service

1. Acceptance of Terms

By accessing or using RefinORE AutoMiner ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.

2. Description of Service

RefinORE AutoMiner is an automated cryptocurrency mining application that interacts with smart contracts on the Solana blockchain. The Service enables users to automatically deploy SOL to mine ORE tokens through an automated bot system. This is experimental blockchain software provided "as-is" without warranties.

3. Embedded Wallets

The Service uses Privy embedded wallets to manage your digital assets. By using the Service, you agree to Privy's Terms of Service available at https://www.privy.io/user-terms-of-service.

CRITICAL: We do not have access to your digital assets. If you lose access to your private keys, we cannot restore them. You must export and securely backup your private keys immediately after creating your wallet. Failure to backup your private keys may result in permanent loss of your digital assets.

You control your wallet and keys. Cryptocurrency transactions are permanent and cannot be reversed. We cannot be held responsible for any loss of funds.

4. Service Fees

The Service charges a 1.00% service fee (0.00025 SOL minimum) on all deployment transactions. This fee is added on top of your deployment amount and transferred to the service fee address as a separate transaction. No service fee is charged on claim transactions.

Token Swaps: A 0.50% fee is charged on all token swaps executed through the Jupiter aggregator.

In addition to service fees, you are responsible for all blockchain transaction fees (gas fees) required to execute transactions on the Solana network. Service fees may be changed at any time. Continued use of the Service after fee changes constitutes acceptance of the new fee structure.

5. Risks and Disclaimers

USE AT YOUR OWN RISK. Cryptocurrency and blockchain technology involve substantial risk. You acknowledge and agree that:

• The Service is experimental software and may contain bugs, errors, or vulnerabilities
• You may lose all funds deployed through the Service
• Smart contract interactions are irreversible and cannot be undone
• Blockchain networks may experience downtime, congestion, or failures
• Cryptocurrency prices are highly volatile and may result in losses
• Automated mining strategies may not be profitable
• We make no guarantees about mining returns or profitability

6. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability to you for all claims arising from or related to the Service shall not exceed $100 USD or the amount you paid to us in the 12 months preceding the claim, whichever is greater.

8. User Responsibilities

You agree to:

• Maintain the security and confidentiality of your account credentials and private keys
• Backup your private keys immediately after wallet creation
• Use the Service only for lawful purposes
• Not use the Service if you are prohibited from doing so by applicable law
• Not attempt to interfere with or disrupt the Service
• Not use automated systems to abuse or exploit the Service

9. Prohibited Uses

You may not:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or related systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit malicious code or engage in any harmful activity
• Impersonate any person or entity or misrepresent your affiliation with any entity

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason including but not limited to violation of these Terms. Upon termination, you must immediately stop using the Service and export your private keys if you have not already done so.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the appropriate courts of that jurisdiction.
